2. Applicability

These Terms & Conditions apply to all offers, orders, and agreements made via www.berckhoffreenactment.com (hereafter “the Website”).

By placing an order, you confirm that you have read, understood, and accepted these Terms & Conditions.

3. Products and Offers

  • Product descriptions and images are displayed as accurately as possible.
  • Small variations in color, size, or appearance may occur due to screen or manufacturing differences.
  • All prices are listed in Euros (€) and include Dutch VAT, unless stated otherwise.
  • Shipping costs are shown separately before checkout.
  • We reserve the right to modify products, prices, or offers at any time.

4. Orders and Payments

  • Orders can be placed via the Website following the checkout process.
  • Payment must be made in full before shipment, using one of the available payment methods (e.g., iDEAL, PayPal, Mollie, credit card, or bank transfer).
  • Once payment is confirmed, you will receive an order confirmation by email.
  • We reserve the right to refuse or cancel orders in cases of suspected fraud, incorrect pricing, or stock errors.

5. Shipping and Delivery

  • We ship from The Netherlands to customers worldwide.
  • Delivery times depend on your location and the chosen shipping method. Estimated delivery times are shown during checkout.
  • Orders are shipped via trusted carriers (e.g., PostNL, DHL, UPS, or others).
  • You will receive a tracking number once your order is dispatched.
  • Customs duties, import taxes, and local handling fees (outside the EU) are the responsibility of the customer.

We are not liable for delays caused by customs procedures, incorrect delivery information, or events beyond our control (e.g., strikes, transport disruptions, force majeure).

6. Right of Withdrawal (EU Consumers)

If you are an EU consumer, you have the right to withdraw from your purchase within 14 days of receiving your order — without giving any reason.

To exercise this right:

  1. Contact us at info@berckhoffwholesale.nl within 14 days of delivery.
  2. Return the item(s) unused, in original packaging, and in resellable condition within 14 days after notifying us.

Refunds:

  • We will refund the full purchase amount (including standard shipping costs) within 14 days after receiving your return.
  • Return shipping costs are at your own expense, unless the return is due to our error or a defective product.

Exclusions:
The right of withdrawal does not apply to:

  • Custom-made or personalized items
  • Products that have been worn, used, or altered
  • Perishable or hygienic goods once unsealed

7. Returns and Exchanges (Worldwide)

We accept returns for refund or exchange if reported within 14 days of receipt.
International customers outside the EU must cover all return shipping and any import duties or fees incurred.

8. Warranty and Defects

We take great care to deliver high-quality products.
If an item is faulty or damaged upon arrival, contact us within 7 days of delivery with photos and a description of the issue.

Depending on the situation, we may:

  • Replace the item,
  • Offer a repair, or
  • Issue a refund.

Our warranty complies with EU consumer protection law.
This warranty does not cover damage caused by misuse, wear and tear, or improper handling.

9. Liability

  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or Website.
  • Our total liability shall never exceed the purchase price of the product in question.
  • We are not responsible for delays, losses, or damages caused by shipping carriers or customs authorities.

10. Intellectual Property

All content on the Website — including text, images, logos, product photos, and designs — is the property of Berckhoff Reenactment / Berckhoff Wholesale V.O.F. or its licensors.

It is not permitted to reproduce, distribute, or use any materials from this Website without prior written permission.

12. Governing Law and Disputes

All agreements and disputes are governed by Dutch law.
In case of a dispute, both parties will first attempt to resolve it amicably.
If no resolution is reached, disputes shall be submitted to the competent court in Almelo, The Netherlands, unless mandatory law states otherwise (for example, for EU consumers).
